PURSUANT TO WORK PERMIT FOR FOREIGNERS LAW NO. 4817
.
The previous Law 4817 on Work Permits in Turkey for Foreigners has been abolished. The International Labor Law 6735 (UIK) has entered into force on the date of publication in the Official Gazette No. 29800 dated 13 August 2016. The replacement law in effect, brings important changes to the work permit policy and system quality, while offering faster foreigner work permit application process in the government online system.  The new law will be the main legislation regulating non-Turkish citizens’ entry into Turkey’s labor market.

The new law is not as procedural as its predecessor. Rather it regulates foreigners’ entry into the Turkish labor market in a more extensive and disciplined way. One of the most important innovations of the new law is the introduction of a new international labor force policy for Turkey -a selective policy toward managing which immigrants will enter the Turkish labor market.

ACCORDING TO FOREIGNERS AND INTERNATIONAL PROTECTION LAW NO. 6458
.

Work permits when applied from outside Turkey is also Residence permit. Foreigners may apply to the Turkish Consulates in the country of citizenship or where they legally reside and enter into Turkey by obtaining “visa for the purpose of work”. However Work permit applications are concluded by Ministry of Labor and Social Security within 30 days in Turkey and not by the Turkish Embassy or Consular missions abroad.

ACCORDING TO INTERNATIONAL LABOR LAW NO. 6735
.

All non-Turkish nationals can work and be employed in Turkey and also benefit from social security, medical and retirement. Work permits in Turkey are issued to individuals first-time for 1 year duration each instance. The normal Foreigner work permit for 1 year may be renewed up to 30 days before expiration date, next for 2 years, and then renew for 3 years, each instance. HOW TO LODGE FOREIGNER WORK PERMIT AND VISA APPLICATION ABROAD?

For foreigners who are offered employment from Turkey, he/she may be hired by the qualified sponsor employer or Turkish company (with job position, salary, employment duration, terms agreed on paper) by the method of an employer and employee signed, Labor contract and Invitation letter for completion.

Terms of employment in Turkey are mainly governed by the Labor Law and Trade Union Law. Pursuant to the Turkish Labor Law, there are various types of employment contracts:

  1. Employment contracts for temporary and permanent work
  2. Employment contracts for a definite period or an indefinite period
  3. Employment contracts for part-time and full-time work
  4. Employment contracts for work-upon-call
  5. Employment contracts with a trial period
  6. Employment contacts constituted with a team contract.

In the case the foreigner lives abroad, may lodge Work permit and visa applicant at the Turkish embassy or consulate, next for
Work visa to be made available to you to enter Turkey.

  • The consulate will provide you back Work permit reference number that you will inform your employer.

  • The Turkish employer in Turkey will then login at the Ministry of Labor and Social Security website to submit the required company documents, either in person or via mail within 10 business days following the date of the candidate’s application to a consulate.

  • The consulates of the Republic of Turkey and the ministry will execute online approval procedures for the work permit applications filed abroad to issue a work visa to travel and enter Turkey. Make sure to have your Police Character Certificate to upload, while doing your work visa application.

  • The Ministry of Labor and Social Security in Turkey shall provide your Turkish employer Work visa reference number usually confirming to issue your Work Visa to travel to Turkey.

  • As Work Permits applied from outside Turkey include residence permit, the foreigner is charged an entry Visa fee, Work permit certificate fee and Residence fee by the Turkish consular offices.

  • Since Work Permit Card substitutes also as residence permit in Turkey, ‘Work Annotated Visa’ issued by these offices can only be used for single entrance and for 90 days at maximum. The Foreigner work permit ID card is made available for first-time, up to 1 year from the Ministry of Labor after you enter Turkey.

  • With the new legislation in effect Foreigner who work  for 5 years in Turkey may apply for Turkish Citizenship.

Foreigners who have signed Turkish employment contract will require work Visa to enter and to start work in Turkey, and who are found fit to meet the conditions set forth in International Labor Law No. 6735 may apply for Foreigner work permit and Visa from abroad, to live and work, or retire in Turkey.
